Does Google PageRank Count Anymore?

Titus Howkins has written this article which is eye opener for those who dont count or count Google PageRank anymore. This is what I used to say to my friends and clients that, "PageRank still counts but just not for ranking factor." Take my words. Here is the article.

"Lately Google has been doing a lot of twitching. Specifically, the rather startling news from Google Webmaster Trends Analyst Susan Moskwa that Google has ditched PageRank from Webmaster Tools.


"We've been telling people for a long time that they shouldn't focus on PageRank so much; many site owners seem to think it's the most important metric for them to track, which is simply not true," states Moskwa. "We removed it because we felt it was silly to tell people not to think about it, but then to show them the data, implying that they should look at it." (Source: WebProNews)


Now, for SEO reasons or for ranking in Google's index, PageRank has long been eunuchified by Google. However, even missing a few dangling bits, history has shown us, eunuchs still wheel tremendous power. PageRank is no different.


Regardless of what Google wants to happen, PageRank is still extremely important to anyone marketing on the web, especially if you're selling SEO services or operating a web business. Try selling SEO services when that little green bar on your site is pointing to PR0 or worst yet, pointing to a solid gray bar.


Obtaining a high PR7 or PR8 simply means more business and revenues... regardless of how Google is or is not using PageRank. People know how to count and they learned long ago, a ten is a lot more than a big fat zero.


Placed against a PR1 site, a PR8 will win more respect in the eyes of potential clients and can produce enormous profits for the site owner and we won't even mention the still widely practiced habit of selling links, which Google is desperately trying to stop. Total and full elimination of PageRank would be an honest start but it will still be an uphill, if not an unwinnable battle, for Google to fully eliminate link selling.


Even with my modest sites, I have turned down a small fortune by not selling text links on any of my sites. When I had a PR6 site instead of a PR4 - those link requests were nearly doubled. So one can easily understand Google's position and the need to downplay PageRank, if they want to put even a small dent in all this link selling and buying, which is still running rampant on today's web.


PageRank is Google's creation, and unless they remove it fully from their system and the Google toolbar, then PageRank still Counts. Actually, in the whole scheme of marketing your website on the net, PageRank counts big time. And in more ways than one.


There are several reasons why you shouldn't count PageRank out.


For years Google has been downplaying the importance of PageRank and states it's only one of about 200 ranking factors which determines how Google ranks its index for keywords. Obtaining top organic rankings for popular lucrative keywords in Google simply means money in the bank. Actually, even a movement of only one or two places on those first page SERPs (Search Engine Results Pages) can make a major difference to any online marketer's bottom line.

Now while you can have a lower PR number and still rank above other higher PR pages for your chosen keywords, I have even had many times when my PR drops but my actual SERPs rankings in Google goes up, mainly due to building related relevant backlinks. So PageRank counts little towards your keyword rankings but it can't be totally dismissed.

Mainly because, even if PR is just one ranking factor, in close competitive keyword battles (I am presently fighting tooth and nail for some very choice keywords) just one ranking factor such as high PR can make the difference of whether or not you get to the top spot. Big dogs are still jumping and for those of us who know how to count, getting a number one spot in Google makes all the difference in the world.

Not only because Google controls roughly 80% of all search engine traffic, but more importantly Google has established unmatched credibility and brand recognition in the eyes of potential customers visiting your site. Web users trust Google. Web users look to Google for guidance and direction. Web users believe what Google is telling them. In the online world, rightly or wrongly, perception is everything.

As an online marketer, I am completely amazed each day at the marketing power Google now commands with web surfers and with the general population. Google is king of online search and no other search engine even comes close to Google.

PageRank is Google's ranking system, and in the eyes of those who notice these things, it still wheels tremendous influence and power. By default, PageRank is Google's opinion of your site, and web users can count (at least to 10) and if Google believes people are still not counting when it comes to PageRank, then they are fully mistaken.

Article marketing continues to be a proven method for generating traffic to our websites and developing good search placement, even after all of these years. I have been reading articles online since 1995, and I continue to read a few dozen articles per week on subjects that are dear to my heart.

Some Claim That Article Marketing Does Not Work

Now and again, I will read a thread in a forum somewhere where somebody claims that article marketing does not work.

Some article-marketing critics will admit that they have only distributed only one or two articles. Well yeah, I can see why article marketing did not work for them - because they did not work at making article marketing profitable for them.

Article marketing is like any other method of advertising. If you don't make a real investment in it, then you cannot reap great rewards from it.

The Marketing Rule Of Seven

Advertising professionals speak of the "Marketing Rule Of Seven," which suggests that a consumer must see your marketing message at least seven times before they start to pay attention to your message. The pros also suggest that once seven exposures have been achieved, the consumer will make a subtle, subconscious connection to the advertiser. Recognition brings rewards, in that after seven exposures to an advertisement, consumers will start to feel as if they know enough about the advertiser to trust their sales message.

If television, radio and print advertisers understand that a company's sales message must be seen or heard at least seven times, then why would you - the Internet marketer - think that you can write a single article and see the full benefit of the medium?

Successful Article Marketing Requires A Commitment To The Reader

All commerce on the Internet is driven by information, such as written sales messages and information about products and services. Some websites also benefit from generic information concerning topics that their potential clients will be interested in reading. For example, if a website sells plumbing supplies, the consumer may find the availability of information about how to remove the old fittings and how to install the new plumbing equipment, as an essential element of their purchase decision.

Article marketing when done correctly will not be a boring, blathering of search engine optimized keywords related to a product or service line.

Article marketing, when done well, will provide information that will be of real interest to the person most likely to buy what you are selling.

For example:

* If you are selling auction services, give the reader tips to help them make more money from the sale of their goods in the auction environment or how a buyer can find a good deal.

* If you are selling auto warranties, tell the reader how to uncover the best value in an auto warranty plan and what features to seek.

* If you are selling resume services, give the reader advice on how to write their own resume.

Article marketing when used well can help a company establish itself as an expert in the field, and it can help show a reader why hiring the author's service might be better than a do-it-yourself project. Beyond the cost of labor, content development is usually the second most expensive expenditure made by the online vendor. It is important to note that just as there are lawyers who specialize in one area of law, there are also ghostwriters who specialize in certain types of content creation.

People who write sales copy are referred to as "copywriters." Copywriters are people who understand the nuances of how to make people buy what you are selling.

1. Ask a question. One of the best ways to get a reader's attention is to ask a question. But like a trial lawyer questioning a witness on the stand, make sure it'll get you the response you're looking for. "What's the best way to grow your business?" is a great subject line for business owners. After all, what business owner wouldn't want to grow his or her business? Or let's say you run a health club. An e-mail with the subject line, "How can you lose 5 pounds in one month?" would certainly be compelling. It's important your question be relevant to your audience.

2. Be a tease. A clever subject line can be enticing. When it's done right, reader curiosity is piqued. They want to know more--and they'll open your e-mail. Writing a teaser-style subject line requires some creativity, and your content needs to deliver. A company that sells high-definition TVs could use the subject line, "You're not going to believe your eyes" as a teaser to introduce a new addition to their product line.

3. Tell it like it is. Often, what works best is to say exactly what you want your reader to know. Examples of this straightforward approach are, "Sale on all sweaters this weekend," "Master jazz pianist plays live this Friday" and "The seven secrets of a profitable business." If you use the same generic language repeatedly, people will stop reading it and it'll be a waste of your time.

1. Your email "from" sender line should be your brand name or company name and stay consistent. Use your own personal name only if that is your brand image.

2. Send emails only when you have something to say that will benefit the reader. No fluff. No filler. You must be relevant. If you can't be, don't send an email until you have something beneficial to say.

3. Start your emails with the specific benefit the reader can get from your message. You have no more than 3 seconds to pass the crucial "what's in it for me?" test.

4. The copywriting tone and language should be personal and conversational, instead of stuffy and "corporate".

5. Make a specific offer to the reader and, if possible, include a short deadline by which he must respond to get it.

6. Use as much copy as is needed to fully pile on all the benefits the reader will get by ordering, answer objections, create urgency, and close the sale.

7. Test your subject lines and offers on small segments of your list before you send the email to your entire list.

8. Include "Email this to a friend" service in all your communications for pass along and viral marketing.

The call-to-action is a determining factor of your click-through rate. It is an important component of your email copy because it answers three important questions for the recipient. They are:

1. What you want them to do

2. Why they should do it, and

3. How to take that next step.

Whatever action you want your recipients to take, you can make it happen more often with a good call-to-action. First, decide what you want them to do:

1. Buy something

2. Sign up for a service

3. Fill out a form

4. Read an article or get more information

5. Visit your website or store

6. Make an appointment

Etc…

Then, make sure you incorporate these 6 characteristics to get the results you're looking for. Make your call-to action:

1. Visible - People read, react, make decisions and take action differently. Some make decisions right away ("You had me at hello.") and some need more details ("I'm from Missouri."). Place call-to-action links in the beginning, middle and end of the email so that recipients can click whenever they are ready.

2. Clear - Stick to simple words, short phrases, bulleted benefits and paragraphs of 1-3 short sentences. Include appropriate graphics and cut the clutter by making effective use of white space.

3. Compelling - Use action-oriented verbs and phrases: "buy now," "call today," "save" and so on.

4. Rewarding - Offer an incentive or reward for action. For example, "Act now and also receives...," or "the First 100 respondents will be entered into a raffle to win..." The giveaway, or prize, you choose should be closely related to your product or service. That way, you will be targeting customers who are interested in what you have to offer, not just the latest gadget.

5. Urgent - The longer an email sits in an inbox, the less likely it is to be acted on. Create a sense of urgency to get a more immediate response. Try limiting the offer to a specific time period, to the "first 50 customers," "while supplies last," etc.

6. Direct - Your call-to-action links should go to the appropriate page on your website with more details on the specific product or service you're promoting. If you don't have a website, the call-to-action might be store locations to visit or a number to call for an appointment.

Keep in mind that, in addition to repeating your call-to-action, you can vary your call-to-action to appeal to different types of buyers (and to fit your sales cycle). For example: "Click here to buy now" will naturally work better with loyal customers. The softer, "Click here to learn more" may be better for newer prospects.

Here are some common problems to look out for:

1. Misspelled words - It's a good idea to spell-check a document, but it's not enough. A spell checker won't catch every error.

2. Wrong word used - This is why a spell checker isn't enough. A spell checker will only flag words it doesn't recognize. It can't tell if a legitimate word is used incorrectly. Some words commonly confused: accept, except; your, you're; then, than; there, their, they're; cite, site, sight; lay, lie; loose, loosen, lose. Also, look out for a missing "r" in the word "your." It's easy to overlook a sentence such as "Visit our Web site now to receive you free copy."

3. Grammar error - Again, if you know you're not a good writer, have someone else check your writing for grammatical errors. Mistakes make you look bad.

4. Punctuation error - This is another area where you'll benefit from a review by someone who knows their stuff. If you're determined to do it yourself, purchase a good grammar or style book. One of the most common punctuation problems: Too many stupid commas!

5. Vague or confusing statement - Make sure every sentence is crystal-clear. You don't want your promotional message to raise more questions than it answers.

6. Illogical statement - Read over what you have written slowly. At the end of each paragraph, ask yourself: "Did that make sense?" Rewrite so that it does.

How Often (Frequency) Should You Send Email?

There's no quick answer to the frequency question. It depends on the goals for your email and the type of content you send. Some rough guidelines:

1. Mail at least once a month. Mail less often than this, and you risk being forgotten by recipients. Monthly is the bare minimum if you want to keep your brand or company name top of mind (a common email goal).

2. Let content be your guide. Look at what you provide readers and you'll get a feel for proper frequency. Analyze how often the information changes and how quickly readers must receive it to act on it.

3. Work within your resources. A daily email requires many more resources than a monthly. Better a well-done monthly email than shoddy weekly or daily. It's recommended to start with a monthly. Once that's going smoothly, they can think about moving to weekly. You need to walk before you can run!

4. Watch for trends. Declining response, open, and click-through rates can be signs of list fatigue. Though some decrease is normal, watch carefully and cut back frequency if you see a problem. Don't assume if the unsubscribe rate is stable you're OK. Many people prefer to forward email directly to their delete folder rather than unsubscribe.

If you send email campaigns long enough, you will inevitably run into spam filter issues. On average, you can expect 10-20% of your emails to just get lost in cyberspace, mostly due to overzealous spam filters. Unfortunately, there is no quick fix. If you want to avoid getting your emails junked by spam filters, you have to understand how they work.

Generally speaking, spam filters look at a long list of criteria to judge whether or not your email is junk. For example, they might look for spammy phrases like "CLICK HERE!" or "FREE! BUY NOW!". They'll assign points each time they see one of those phrases. Certain criteria get more points than others. Here's a sample of criteria from Spam Assassin, one of the most popular spam filters out there:

• Talks about lots of money (.193 points)

• Describes some sort of breakthrough (.232 points)

• Looks like mortgage pitch (.297 points)

• Contains urgent matter (.288 points)

• Money back guarantee (2.051 points)

• Why Pay More? (1.249 points)

It's easy to use "spammy" keywords in your email without even knowing it. Here are some common ways marketers unwittingly trigger spam filters with their campaigns:

1. Using spammy phrases, like "Click here!" or "Once in a lifetime opportunity!" too many times in your email. Sometimes, you can't avoid phrases like "FREE SHIPPING!" but use them sparingly, and don't do anything else risky.

2. Going crazy with exclamation points!!!!!!

3. USING ALL CAPS, WHICH IS LIKE YELLING IN EMAIL

4. Coloring their fonts bright red, or green

5. Coding sloppy HTML (such as by converting a Microsoft Word file to HTML)

6. Creating an HTML email that's nothing but one big image, with no text (since spam filters can't read images, they assume you're a spammer that's trying to trick 'em)

7. Using the word "Test" in the subject line (agencies run into this all the time, when sending drafts to clients for approval)

If Your Email Marketing Does not Work, Think Again Why?

Before you arrive at the faulty conclusion that email marketing doesn't work, let’s look at this from a different perspective for a moment that would make your emails ineffective.

First there's what you are writing in the body of the email. If this is your first attempt to get in touch with a prospect, what are you putting in the email? A dissertation? If it's longer than one or two paragraphs, it's too long. Look at your emails like an initial cold call. You need to laser in and deliver a compelling opening statement that's going to grab their interest and stimulate a conversation. Because there's no one to cut you off in an email or stop you from persistent pontification, people have tendency to ramble on and on in an email, giving the prospect the life story of the product or service they want them to consider. Second, are you sending attachments in the first email? No attachments! It's hard enough sending an unsolicited email to a prospect. Now you're adding more barriers and increasing the chances of your email winding up in their spam box or junk email folder. Some people have filters on their email that if an attachment is sent it automatically gets deleted. No attachment until that information in the attachment is solicited by the person.

Third, html or text? Once again, with all the email filters people use today, you will increase your odds by sending a text message only rather than trying to get fancy with formatting, graphics and pictures. The prospect really doesn't care about how beautiful your email looks; they care about the core message. Besides, they will never even get a chance to see your beautiful masterpiece in an html email if it's winding up in the trash.

Finally, you are using way too many spam words. As mentioned, the biggest enemy to email marketing or selling via email is the additional security that companies and individuals have on their network or computer. As such, the specific words you are using in the body of the email can be the culprit who is sending your email directly into the trash or spam box. In other words, you are using words that are often identified is spam and in turn, you email is getting flagged and deleted. Not even eye contact! The prospect is not getting a chance to, at the very least, see your email let alone read it and have a chance to respond accordingly.

10 SEO Power Tips To maximize traffic



How do you know what type of content is really going to attract the right searchers?

In this article I wanted to cover a few very basic tips that you can keep in mind when building high-performance strategies. Remember that good search engine marketing is not about trying to manipulate or "fool the search engines." Good SEO skills are more about creating genuine relevancy for well-written content that deserves to be found because it is truly the most relevant and useful to your audience of readers.

What students quickly discover in the 5-Day classes is that the optimization skills are not nearly as hard as many people make them out to be (even for the most competitive phrases,) once you've been trained and understand the full scope of influences that are at work. The biggest advantage that we have had is all about the "accuracy of information."


1. Write content that your audience is already looking for within the last 90 days.

True keyword research is not about 'guessing at keywords' but its all about researching actual data. How are your SEO research skills using Wordtracker or Keyword Discovery? At the SEO Workshops we teach much more than the traditional "keyword research" methods. We help students learn "Keyword Forensics" and how to quickly tap into the hidden niche trends that 99% of most Webmasters never even notice.

2. Does your Web copy speak to the reader or does it speak about yourself?

Remember that your Web site should be focused on your audience first and appeal specifically to a niche interest. When writing your Web copy, you need to dialog in an appropriate tone and format for the right audience. Some of the most interesting content will have more appeal if it speaks to your audience in terms of "you." You can, you might, you will, yours, your and you're INSTEAD of we, ours, we're, we will, we can, etc.

3. Focus on writing for the human audience first and search engines second.

While search engine optimization is important to your visibility, try writing your content first. Most people don't write their best when trying to optimize and create content at the same time. Focus on creating highly useful content that is extremely focused on one topic per page. Once you have completed your writing so that you are pleased with it, then go in to do a mild re-write for the search engines.

4. Tips for triggering idea generation and giving your strategies a unique twist.

While many people seem to spend time exploring their competitor's Web sites, we encourage you to lead the way with new ideas. Try not to be obsessed with what the competition is doing, but be creative and start your own new trends. Spend just a little more time working on your projects this week than you did last week. Setting yourself apart from the competition is easier than you might think and gives you a huge advantage over others.

5. Creating your content so that it "speaks" to a specific audience of visitors.

Think of how your Web copy reads and ensure the dialog flows smoothly. Read your work out loud and see if you can improve the tone of your message with natural expression. Keep your specific audience in mind. How you write for senior citizen (in tone and in format) may differ considerably from writing for an audience of for example "new parents." Always ask yourself "what is important to these readers?" Rely on researching accurate data to eliminate guess work.

6. Remember strong calls to action

Without a firm call to action, don't expect the reader to naturally guess at what you want them to do next. Plain ordinary dialog that asks the reader to take the next action will usually work best. Dialog that is written for voice (similar to the way a broadcaster writes to project their personality.)

7. Build your search engine optimization skills in the beginning with the "stress free" approach.

If you are new to SEO, you may want to focus on the long tailed niche phrases since most searchers are doing fairly descriptive and intelligent searches these days. Ideally you want to attract those who already know what they are looking for and just need to find your pages more easily. With practice and the right training you can go after highly competitive phrases too but you'll find that the best conversions nearly always come from the niches. Also remember that it is the basic SEO skills that carry you through and must come before any of the advanced strategies. The result will be stable top rankings that stand the test of time with minimal fuss.


8. Give your readers a non-threatening reason to respond right now.

What is the objective for your page and does your Web copy work effectively at fulfilling that objective? It may not always be about trying to sell a product or a service. It should not be about fulfilling your needs first but it should be about meeting the needs of why that searcher first conducted a search. Meet their needs and deliver up something that satisfies their search first and then give the visitor a non-threatening reason why they might respond to you. Do you want their e-mail address? Or do you just want them to pick up the phone and call? Never lose sight of the fact that the Web is a marvelous two way interactive experience, if you want it to be. Make your Web site a vehicle for relationship building and remember that many readers may actually have the desire to interact and participate through Blogs or other "User Generated activity." Give your visitors something that involves their participation.

9. Remember that your readers always want to feel like they are in control of their Web experience.

People often use the Web for researching topics of interest or doing preliminary price comparisons or for looking up information. While most people explore the Web for their own purposes, the more that you put them in control of their experience the better. If appropriate, you may want to consider adding additional tools or functionality to your Web site in order to enhance its usability for your specific audience.

10. Did you know that if you write your content so that it naturally "reads very well."

You will naturally gain some bonus for having created content of quality. By this, I mean content...that reads well to a human being. Don't stuff keywords all over the place. Instead, use moderation in everything you do. One of the things you need to understand is that "theme based" search engines like Google, are actually using a measure of artificial intelligence (AI) to measure how well your article "reads" based on all of the overall context of your body text (other than the keywords) based on data that a search engine has gathered concerning a specific topic. This is great news for writers because if you are making a transition to writing for the web, you'll find some search engines are literally rewarding pages that are "well written."

Many brick and mortar companies that are catering to their local clientele find it hard to SEO for local markets despite targeting the best keywords. Quite naturally this is not a surprising matter as many of them, although efficient in running their off line businesses, typically stumble over two critical blocks.

Trademark Infringement Issues For Pay-Per-Click (PPC) Advertisers




Yahoo has just announced they will no longer allow PPC advertisers to advertise or bid on trademarked terms.

Could this be a trend of things to come from the other major search players?

MSN’s new adCenter (still in beta) states you are not allowed to infringe trademarks within their editorial guidelines (see policy below).

However, Google still maintains a strong stance in allowing advertisers to bid on trademarked search terms as long as the trademarked term is not used within the advertiser’s ad-copy.

Numbers to Consider

Next to click fraud, trademark violations are the second largest concern to Pay-Per-Click (PPC) advertising. Out of the total number of searches online, 20% are trademark searches. Meaning, company owned trademarks such as “Pontiac”, account for 20% of all search traffic. While 1 in 5 searches for trademark terms may seem high, most conversions do not originate from trademarked terms. A study by comScore and Yahoo Search Marketing (Overture) found most buyers do not search by manufacturer or product name. Rather, buyers use broad search terms that do not include a manufacturer’s name. Broad search terms account for 70% of total searches and 60% of total conversions.

Search Engine’s Policy on PPC Trademark Bidding

Yahoo on Trademarks:

"On March 1, 2006, Yahoo! Search Marketing will modify its editorial guidelines regarding the use of keywords containing trademarks. Previously, we allowed competitive advertising by allowing advertisers to bid on third-party trademarks if those advertisers offered detailed comparative information about the trademark owners' products or services in comparison to the competitive products and services that were offered or promoted on the advertisers' site.

In order to more easily deliver quality user experiences when users search on terms that are trademarks, Yahoo! Search Marketing has determined that we will no longer allow bidding on keywords containing competitor trademarks."

MSN AdCenter on Trademarks

“Microsoft requires all advertisers to agree that they will not bid on keywords, or use in the text of their advertisements, any word whose use would infringe the trademark of any third party or would otherwise be unlawful or in violation of the rights of any third party”.

Google Adwords on Trademarks:

“Google takes allegations of trademark infringement very seriously and, as a courtesy, we're happy to investigate matters raised by trademark owners. Also, our Terms and Conditions with advertisers prohibit intellectual property infringement by advertisers and make it clear that advertisers are responsible for the keywords they choose to generate advertisements and the text that they choose to use in those advertisements.”

Solution or More Problems

With all Engines moving toward a TM standard, it would have many benefits to both advertisers and searchers. This standard would be good for marketers who would have to be more creative in their copy creation creating increased demand for qualified marketers which would translate into higher fees. Search Engines hosting the ads would maintain revenue levels, but online public relations firms may lose as they would not be required to police search engines for their clients with trademarks. Lastly, the mark owner would continue to be protected and user experience would not be affected.

Case Study:

I’m currently working with an AdWords client in a circumstance where their competitors are bidding on their trademarked search terms. Aside from the constant policing and reporting for trademark violations used in the ads themselves, adspend to secure top positions for their ads has skyrocketed from an initial $2.00 per click to $15.00 per click. Additionally, monthly spend has increased from $1,200 to nearly $30,000.

I have to go back to my client with an estimated budget of $500,000 for the rest of this year to control the space for their own branded trademarked term. I am reluctant to do that as it doesn’t make sense with the announcement from Yahoo on their new trademark policy. Given the level of aggression by the competitors and the extortionate cost now been borne by my client there is only one solution and that is to stop all advertisers from bidding on the terms. In my opinion, it is simply not right that a business owner has to spend $500,000+ to buy their own branded term that has already cost them millions of dollars to build. This is $500,000+ in revenue for Google which is being generated by a policy that is beyond elementary business terms. Yahoo and MSN have recognized the injustice of this policy and have taken steps to change it.

If we cannot treat this policy on a case by case basis, then I have no alternative than to advise my client that we cannot help them any further and their only option is to resort to legal action against Google.

Google also advises that you take the matter up with individual advertisers which in many cases are impossible with private registrations and foreign companies. You could add to your high costs dramatically to have to send cease desists to all infringers. Many will ignore you.

The classic bait and switch does not seem to apply to the Internet. Many companies are okay with their terms being bought for comparison shopping and by re-sellers. The solution here is for those companies to give permission to Google to allow their re-sellers to purchase the name. With the strength and sophistication of Google’s technology how difficult can this be? I doubt it is any more cumbersome than filtering search results for China.

Your Defense Against Trademark Violations

Website companies where the majority of their revenue is generated through online sales depend heavily on search engines to generate traffic to their website. In order to defend against trademark infringements you will need to conduct search audits at least once every month. You not only need to look over organic search results, but also paid search results or PPC contextual ads. You should look through the top 30 results of the search listings.

For organic search engine results you should look at both the questionable result and the site displayed in the result. When looking over the possible violator’s site, don’t just look over the visible content on the site; look over the code as well to uncover hidden text, image alt tags and keyword meta tags that may include your trademarked names.

Then document your findings. For search engine results and PPC results use a “screen capture” of the page displaying the mark infringement. For mark infringements that are visible on a website, save the entire page’s code as a .txt file.

What about if you are you seeing an infringement in organic search results, but when you click on the page, there is no infringement? They may be using a cloaked page which includes your trademark. To check this out you will need to view the search engine’s cached page on file. Make sure to save a copy of this code as well.

You will need to document your findings properly by dating the violation as well as the site owner’s complete contact information. Use http://www.dnsstuff.com to get the whois information for the site. Once you have all of this documented you will need to send your findings to the appropriate search engine.

You may also want to take the legal route, in which case you should keep a record of all your documentation to present to your legal counsel.

The best way to gather evidence is to hire a third party to collect evidence against the infringer of your trademark or copyrighted material. Recently at Search Engine Strategies in New York City during February of 2006, Deborah Wilcox, Partner of Baker & Hostetler LLP who specializes in trademark and copyright areas of law said, “Use a third party to make print outs and audit the search results. If the case goes to court you will need hard evidence for the judge.”
